Participant Agreement & Waiver

Acknowledgment of Risk, Release, Indemnification, and Medical Authorization. This is what you accept when you buy a pass, join as a member, or book a party — and when you visit us.

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS IMPORTANT LEGAL RIGHTS.

In consideration for being permitted to enter, attend, use, or participate in the premises, play areas, equipment, programs, parties, events, food-service areas, and activities offered by Little Town Playhouse – Fairfield LLC, I agree to the following terms for myself and for each minor child in my care.

1. Parties Covered by This Agreement

For purposes of this Agreement, “Little Town Playhouse” means Little Town Playhouse – Fairfield LLC; Gifford Properties LLC; the owner and operator of the premises; and each of their respective members, managers, owners, officers, employees, contractors, volunteers, agents, landlords, affiliated companies, successors, insurers, and representatives.

“Participant” means the accepting adult and every minor child that adult brings to or supervises at the facility.

2. Parent or Legal Guardian Authority

I certify that:

  • I am at least 18 years old.
  • I am the parent or lawful legal guardian of each minor child I bring to the facility, or I have been expressly authorized by that child’s parent or legal guardian to supervise the child and accept the facility rules on the child’s behalf.
  • The information I provide is true and complete.
  • I will not bring or leave a child at the facility unless I have authority to do so.
  • I understand that Little Town Playhouse may require confirmation of my identity or authority.
  • I understand that this is not a drop-off childcare facility unless Little Town Playhouse expressly advertises and separately agrees in writing to provide a supervised drop-off program.

3. Continuous Adult Supervision Required

I understand and agree that the responsible adult accompanying a child must:

  • Remain inside the facility and readily available at all times.
  • Actively supervise the child at all times.
  • Maintain visual or immediate awareness of the child’s location and activities.
  • Determine whether each activity and piece of equipment is appropriate for the child’s age, size, abilities, health, and development.
  • Intervene immediately when the child is using equipment improperly, engaging in unsafe conduct, or creating a danger to themselves or others.
  • Accompany the child to restrooms and other areas as appropriate.
  • Not rely upon Little Town Playhouse employees to provide individual childcare, continuous one-on-one supervision, or monitoring of the child.

I understand that employees may enforce rules and assist with facility operations, but their presence does not replace my responsibility to supervise the child.

4. Acknowledgment of Activities and Risks

I understand that Little Town Playhouse contains indoor play structures, playhouses, climbing features, slides, steps, platforms, tunnels, toys, loose play materials, furniture, hard surfaces, moving children, food, beverages, and other recreational features.

I understand that participation involves foreseeable and unforeseeable risks, including, without limitation:

  • Slips, trips, falls, and collisions.
  • Falls from play structures, steps, platforms, slides, furniture, or equipment.
  • Contact or collisions with children, adults, toys, equipment, walls, floors, doors, fixtures, or furniture.
  • Cuts, scrapes, bruises, splinters, pinches, burns, sprains, strains, fractures, concussions, dental injuries, eye injuries, and other bodily injuries.
  • Entrapment, strangulation, suffocation, choking, or ingestion of food, drinks, toys, small objects, broken pieces, or play materials.
  • Allergic reactions, including serious or life-threatening food-related or environmental reactions.
  • Exposure to germs, bacteria, viruses, communicable illnesses, bodily fluids, insects, cleaning products, or allergens.
  • Injuries resulting from misuse of equipment, failure to follow instructions, inadequate supervision, horseplay, running, pushing, climbing, throwing objects, or conduct by other guests.
  • Damage to or loss of clothing, glasses, phones, jewelry, personal belongings, or other property.
  • Serious injury, permanent disability, paralysis, emotional distress, or death.

I understand that Little Town Playhouse cannot guarantee that the premises will be free from every hazard, small object, allergen, contaminant, illness, or unsafe action by another guest.

5. Choking Hazards and Small Objects

I specifically acknowledge that toys, play materials, personal belongings, food, candy, decorations, party supplies, coins, broken toy components, and other small objects may create choking, swallowing, aspiration, suffocation, or other hazards.

I agree that I am responsible for:

  • Determining whether toys and materials are age-appropriate for each child under my supervision.
  • Preventing children from placing toys, play materials, or non-food objects into their mouths.
  • Closely supervising children who are younger than three years old or who have a history of mouthing objects, swallowing difficulties, developmental conditions, or elevated choking risk.
  • Immediately reporting any broken toy, loose component, small object, damaged equipment, spill, or unsafe condition to an employee.
  • Not bringing toys, balloons, beads, magnets, button batteries, water beads, sharp objects, or other hazardous items into the play area.

6. Food, Beverages, Allergies, and Dietary Restrictions

I understand that food and beverages may be prepared, sold, served, consumed, or brought into the facility. I acknowledge that Little Town Playhouse cannot guarantee an allergen-free environment or prevent all cross-contact.

I am solely responsible for:

  • Informing staff of known allergies when ordering food or registering for an event.
  • Reviewing ingredients and deciding whether a food or drink is safe for a Participant.
  • Supervising all eating and drinking.
  • Cutting food into age-appropriate pieces.
  • Preventing children from sharing food or drinks.
  • Ensuring that necessary medications, including prescribed epinephrine, are immediately available and properly maintained.
  • Informing Little Town Playhouse of any condition that may require emergency assistance.

Unless expressly agreed in writing, Little Town Playhouse does not undertake responsibility for administering medication, monitoring dietary restrictions, or guaranteeing that any item is free from allergens.

7. Health and Fitness to Participate

I certify that each Participant is physically and developmentally capable of safely participating in the activities I permit them to undertake.

I will not enter or permit a child to enter when the Participant:

  • Has a fever, vomiting, diarrhea, unexplained rash, contagious illness, or symptoms that reasonably present a health risk to others.
  • Has been instructed by a medical professional to avoid physical play.
  • Is under the influence of alcohol, cannabis, illegal drugs, or impairing medication.
  • Has a medical condition requiring supervision or accommodation that I have not disclosed when disclosure is reasonably necessary for safety.

I understand that Little Town Playhouse does not provide medical advice and does not represent that any activity is suitable for a particular Participant.

8. Facility Rules

I agree that all Participants under my supervision will comply with posted and verbal rules, including the following:

  • Children must be actively supervised by a responsible adult.
  • No running, pushing, fighting, rough play, throwing objects, or dangerous conduct.
  • Equipment must be used only as intended.
  • Participants may not climb on roofs, walls, railings, gates, counters, furniture, or areas not designed for climbing.
  • Age, height, weight, capacity, and occupancy restrictions must be followed.
  • Food, drinks, gum, candy, and choking hazards must remain outside designated play areas.
  • Shoes, socks, or other footwear requirements must be followed as posted.
  • Damaged equipment, spills, injuries, and unsafe conditions must be reported immediately.
  • Sick or contagious Participants may not enter or remain in the facility.
  • Weapons, smoking, vaping, illegal drugs, intoxication, threatening conduct, and harassment are prohibited.
  • Children may not leave the facility unless accompanied by their responsible adult.
  • Guests must follow employee instructions concerning health, safety, conduct, evacuation, or facility operations.

Little Town Playhouse may deny admission or require any person to leave for violating rules, presenting a safety concern, behaving disruptively, or failing to supervise a child. No refund is required when removal results from a rule violation or unsafe conduct.

9. Assumption of Risk

To the fullest extent permitted by Illinois law, I knowingly and voluntarily accept and assume all inherent and ordinary risks associated with entering and using the facility, including risks described in this Agreement and risks arising from the actions of Participants, other guests, or third parties.

I understand that accepting this Agreement does not require me to allow a child to participate in any particular activity. I am responsible for restricting the child from any activity that I believe is unsafe or inappropriate.

10. Adult’s Release of Claims

To the fullest extent permitted by law, I release and agree not to sue Little Town Playhouse for claims belonging personally to me that arise from ordinary negligence and relate to my or a minor Participant’s entry, presence, participation, supervision, or use of the facility.

This includes, to the extent permitted by law, my personal claims for medical expenses, loss of services, loss of consortium, emotional distress, property damage, or other damages that belong to me individually.

This provision is not intended to release claims that cannot legally be released, including claims arising from willful and wanton misconduct, reckless misconduct, intentional wrongdoing, or any other liability that Illinois law prohibits from being waived.

Nothing in this Agreement is intended to improperly waive or extinguish a minor child’s legal rights where such rights cannot lawfully be waived by a parent or guardian.

11. Indemnification for Participant Conduct

To the fullest extent permitted by law, I agree to defend, indemnify, and hold harmless Little Town Playhouse from third-party claims, damages, losses, judgments, and reasonable legal expenses caused by:

  • My violation of this Agreement.
  • My failure to supervise a child.
  • False information or a false representation of parental, guardianship, or supervisory authority.
  • Intentional, reckless, or negligent misconduct by me or a Participant under my supervision.
  • Damage caused by me or a Participant to the facility, equipment, or property of another person.
  • A Participant bringing a prohibited or hazardous item into the facility.

This provision is not intended to require me to indemnify Little Town Playhouse for liability that cannot lawfully be transferred or that results solely from Little Town Playhouse’s willful and wanton misconduct or intentional wrongdoing.

12. Emergency Medical Care

In the event of an apparent emergency, I authorize Little Town Playhouse to:

  • Contact 911, emergency medical personnel, law enforcement, or other emergency responders.
  • Provide reasonable first-aid assistance within the responder’s level of training.
  • Use an automated external defibrillator, if available and reasonably believed necessary.
  • Provide emergency responders with information supplied through this Agreement.
  • Arrange emergency transportation when reasonably believed necessary.

I understand that Little Town Playhouse does not guarantee the availability of trained medical personnel or any particular emergency equipment.

I accept financial responsibility for ambulance service, emergency treatment, hospital care, medication, and other medical expenses incurred on behalf of me or a Participant under my supervision, subject to applicable law and insurance coverage.

13. Reporting Injuries and Unsafe Conditions

I agree to immediately report every injury, suspected injury, damaged item, loose component, spill, choking hazard, or unsafe condition to an employee before leaving the facility.

I agree to reasonably cooperate in completing an incident report. Completion of an incident report is not an admission of fault by any person or entity.

14. Personal Property

I understand that Little Town Playhouse is not responsible for lost, stolen, misplaced, or damaged personal property except to the extent liability cannot legally be excluded.

15. Security Cameras

I understand that security cameras may be used in common areas for safety, security, incident investigation, and business operations. Cameras will not knowingly be placed in restrooms or other areas where a person has a reasonable expectation of bodily privacy.

16. Photography and Marketing — Optional

Authorization to use photographs or recordings for promotional purposes is optional and is not a condition of admission.

Accepting this Agreement does not give that authorization. Unless you separately and expressly authorize it at the facility, Little Town Playhouse will not intentionally use identifiable photographs or recordings of you or the minor children in your care for promotional, social-media, website, or advertising purposes. You may give or withdraw that authorization at any time by telling a member of staff or emailing littletownplayhousellc@gmail.com.

I understand that incidental appearances in general crowd images or security recordings may occur.

17. Electronic Acceptance and Continuing Effect

I agree that:

  • My checkbox acceptance is my electronic signature and has the same legal effect as a handwritten signature.
  • I had the opportunity to read this entire Agreement before accepting it.
  • I may save or print a copy.
  • Little Town Playhouse may retain an electronic record of my acceptance, including the date, time, account information, and transaction information.
  • This Agreement applies to the current visit and future visits for twelve months after the date of acceptance unless Little Town Playhouse requires a new agreement sooner.
  • A materially updated agreement must be accepted before subsequent participation.

18. Illinois Law and Venue

This Agreement shall be interpreted under Illinois law, without applying rules that would require the use of another state’s law.

To the extent legally enforceable, any legal action arising from this Agreement or participation at Little Town Playhouse shall be brought in a state or federal court having jurisdiction over Wayne County, Illinois.

19. Severability

If any provision of this Agreement is found invalid or unenforceable, it shall be modified only to the minimum extent necessary or severed, and the remaining provisions shall continue in effect.

The headings are provided for convenience and do not limit the meaning of any provision.

20. Entire Agreement; No Oral Modification

This Agreement, together with the posted facility rules and any separately executed party or event agreement, constitutes the entire agreement concerning the matters addressed here. No oral statement changes this Agreement.

21. Acknowledgment

BY TICKING THE ACCEPTANCE BOX, I CONFIRM THAT:

  • I HAVE READ AND UNDERSTAND THIS AGREEMENT.
  • I UNDERSTAND THAT PLAY ACTIVITIES INVOLVE RISKS, INCLUDING CHOKING, FALLS, COLLISIONS, SERIOUS INJURY, AND DEATH.
  • I UNDERSTAND MY RESPONSIBILITY TO ACTIVELY SUPERVISE EACH CHILD.
  • I VOLUNTARILY ACCEPT THE TERMS OF THIS AGREEMENT.
  • I UNDERSTAND THAT THIS AGREEMENT AFFECTS IMPORTANT LEGAL RIGHTS.
  • I HAVE HAD THE OPPORTUNITY TO ASK QUESTIONS OR CONSULT AN ATTORNEY BEFORE ACCEPTING.
